If you are affected by domestic abuse, it is important to share this information with your Cafcass Family Court Adviser (FCA) or the court as early as possible. Domestic abuse can significantly impact decisions about child arrangements, and your safety and your child’s safety are the priority.

For some families, taking part may well be suitable however for some families taking part would not be safe or suitable. Before recommending a Planning Together for Children referral, the FCA will assess the situation using Cafcass Child Impact Assessment Framework. This assessment considers any harm or risk of harm to you and your child and whether participation in the course is appropriate.

If domestic abuse is disclosed or suspected:

  • The FCA will assess the impact of the abuse on you and your child, including any risk of further harm.
  • Where there is a current risk to a child, the FCA will follow formal child protection procedures, which may include making a referral to the local authority and informing the court.
  • FCAs will consider whether any interim contact arrangements are safe and may recommend changes to protect you and your child.

Facilitators and practitioners are trained to recognise signs of domestic abuse and will take appropriate steps if concerns arise during any stage of court proceedings. Your safety and your child’s welfare are central to all decisions.
